GrassWorx™ Acoustical Matting Limited Warranty

GrassWorx warrants for a period of twelve (12) months from purchase that the product is free from defects in material and workmanship (the “Limited Warranty”). Without limiting the limitation of the foregoing, the Limited Warranty excludes damages due to (i) failure to store, use or install the product in accordance with the above instructions, (ii) cracking of underlayment, flooring materials or the non-performance of other system components, or other failure in the system design, (iii) use of the product other than its intended purpose and normal usage, (iv) shipment of the product, or (v) the product not being properly installed by a qualified contractor experienced in installing the product. Any claim under the Limited Warranty must be made within twelve (12) months from the date of purchase. The Limited Warranty is made IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE and in consideration for the express Limited Warranty, BUYER EXPRESSLY WAIVES ANY RIGHT TO CLAIM OTHER WARRANTIES, EXPRESS AND IMPLIED. GrassWorx’s sole obligation, and the buyer’s exclusive remedy, with respect to any product, whether arising in contract, tort (including negligence), strict liability, breach of warranty or otherwise, is limited to GrassWorx, at its sole discretion, replacing or repairing the defective product or issuing the buyer a credit equal to the price paid to GrassWorx for such defective product, and in no event will GrassWorx’s liability exceed the amounts actually received by GrassWorx for the product. GrassWorx shall not be liable for special, punitive, incidental or consequential damages, directly or indirectly sustained (even if seller has been notified of the possibility of such damages) arising from or related to the product, including, without limitation, any loss of profits or loss of opportunity, all of which are waived by the buyer.
